Terms of participation
§ 1 Referring affiliate partner
- Participation as an affiliate partner (hereinafter the “partner”) is open exclusively to businesses within the meaning of section 14 of the German Civil Code (BGB) – companies, self-employed persons, freelancers and small businesses – for example drivers, existing customers, partners with reach (agencies, customs agencies, tax advisors, creators, associations, etc.) and other businesses. Private individuals cannot participate.
- Participation requires a business or self-employed activity, as payouts are made by self-billing with a tax number or VAT ID.
- After activation by DAGO Express, the partner receives a personal voucher code.
- The commission is 2 % of the referred customer's net revenue over 12 months. There is no minimum order value — the commission arises from the first completed and paid order.
- The commission is not capped. Only fully completed and fully paid orders earn commission — cancelled, open, partially paid or refunded orders do not; amounts already credited are reversed in those cases.
- The 12-month period starts with the referred customer’s first order (first use of the code). After it ends, no further commission is calculated.
§ 2 Referred new customer
- The referred customer must be a new customer (no existing business relationship with DAGO Express).
- The new customer receives a one-off discount of 50% (max €30, applies to bookings made in euros) on their first order, provided they enter the voucher code when booking.
- A customer who has already been referred cannot be referred again – not even after the period has ended.
- A customer also does not count as new if they were already in contact with DAGO Express sales before their first order with the voucher code – in particular if a quote, a meeting or a sales conversation took place within the previous 90 days.
§ 3 Payout
- Commissions are credited to the partner account after each completed and paid order.
- A payout can be requested once per calendar month as soon as the balance is at least 100 (in the currency of the partner account: EUR or USD). A lower balance remains on the partner account.
- Payouts are made under the self-billing procedure: before the first payout, the partner accepts the self-billing agreement, DAGO Express issues the self-billing invoice and sends it to the partner as a PDF. The partner does not issue their own invoices for the same commissions.
- The partner stores their bank details in the partner cockpit; they are used solely for paying out commissions.
- All commission amounts are net. The partner is responsible for paying tax on them. DAGO Express shows VAT on the self-billing invoice where it applies; none is shown for small businesses, and for partners based outside Germany the self-billing invoice is issued without German VAT (reverse charge, where applicable).
§ 4 Referral and attribution
- A referred customer is assigned to the partner only if the voucher code is entered with the first order. Assignment after the fact is not possible.
- If several partners refer the same customer, only the code used with the first order counts.
- When sharing the code, the following are not allowed: unsolicited advertising (spam) by e-mail, SMS, messenger or telephone; search engine ads on the DAGO brand or similar terms; publishing the code on voucher and discount portals; creating the impression of acting on behalf of DAGO Express; misleading or false statements about DAGO Express or the programme. Breaches will result in the commission being withheld and the partner account being blocked.
§ 5 General provisions
- Self-referrals and referrals of already existing customers are excluded.
- Taking part in the programme creates neither an employment relationship nor a commercial agency relationship. The partner is not entitled to represent DAGO Express or to make declarations on its behalf.
- In case of abuse or fraud, DAGO Express reserves the right to cancel bonuses and block accounts.
- DAGO Express may adjust or end the programme at any time. Changes apply to the future only; commissions already properly earned are paid out, including below 100 €. Where abuse or fraud is confirmed, no payout is made.
- DAGO Express may terminate the partnership with immediate effect in case of unfair behaviour, deception, manipulation or breach of these terms.
- In the event of reasonable suspicion of abuse or fraud, DAGO Express may temporarily suspend payouts and withhold outstanding commissions until the matter is clarified.
- Commissions obtained wrongfully or through inadmissible referrals are forfeited and may be reclaimed or offset against future balance.
- If abuse or fraud is confirmed, all claims of the partner under this programme are forfeited — including commissions already credited but not yet paid out. DAGO Express retains these amounts and is not obliged to pay them out. Abuse includes in particular false or multiple accounts as well as attempts to circumvent these rules; such cases may additionally lead to permanent exclusion.
- German law applies. Where the partner is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Frankfurt (Oder).
- Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
